These Terms of Service (the "Terms") govern your access to and use of the website located at www.variant1.com (the "Site") and any services provided through it by Variant1 Digital Marketing Inc. ("Variant1," "we," "us," or "our"). By accessing or using the Site, you agree to these Terms. If you do not agree, please do not use the Site.

The Site describes marketing, lead generation, consulting, and related services that Variant1 offers to business clients. Information on the Site is provided for general informational purposes only and does not constitute a binding offer of services. Any services we provide to a client will be governed by a separate written agreement (such as a statement of work, service agreement, or subscription agreement) executed between Variant1 and that client. In the event of a conflict between these Terms and such a written agreement, the written agreement will control with respect to the services it covers.
The Site and its contents, including but not limited to text, graphics, logos, images, video, audio, software, design elements, case studies, and other materials (collectively, the "Content"), are owned by or licensed to Variant1 and are protected by Canadian and international copyright, trademark, and other intellectual property laws.
Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and view the Content for your own personal or internal business reference. You may not reproduce, distribute, modify, publicly display, publicly perform, create derivative works from, sell, or otherwise commercially exploit any Content without our prior written permission.
"Variant1" and the Variant1 logo are trademarks of Variant1 Digital Marketing Inc. You may not use these trademarks without our prior written consent.
If you submit information to us through the Site, including through contact forms, lead magnets, or email, you represent that the information you provide is accurate and that you have the right to provide it. You grant Variant1 the right to use the information you submit for the purpose of responding to your inquiry, providing requested materials, and otherwise communicating with you, subject to our Privacy Policy.
If you voluntarily submit ideas, suggestions, or feedback to us, you agree that we may use them without obligation or compensation to you.
The Site may contain links to third-party websites, products, or services that are not owned or controlled by Variant1. We provide these links for convenience only and do not endorse or assume responsibility for any third-party sites, content, products, or services. Your use of any third-party site is at your own risk and subject to the terms and policies of that site.
The Site and all Content are provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied. To the fullest extent permitted by law, Variant1 disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and any warranties arising from course of dealing or usage of trade.
We do not warrant that the Site will be uninterrupted, error-free, secure, or free of viruses or other harmful components. Any results, case studies, or performance figures described on the Site reflect specific client engagements and are not a guarantee of similar outcomes for any other client.
To the fullest extent permitted by law, Variant1 and its directors, officers, employees, contractors, and affiliates will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenue, data, business opportunities, or goodwill, arising out of or related to your access to or use of the Site, whether based on contract, tort (including negligence), statute, or any other legal theory, even if we have been advised of the possibility of such damages.
Our total aggregate liability arising out of or related to the Site or these Terms will not exceed one hundred Canadian dollars (CAD $100). This limitation does not apply to liability that cannot be limited or excluded under applicable law.
You agree to indemnify, defend, and hold harmless Variant1 and its directors, officers, employees, contractors, and affiliates from and against any claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or related to your use of the Site, your violation of these Terms, or your violation of any law or third-party right.
These Terms are governed by the laws of the Province of British Columbia and the federal laws of Canada applicable in British Columbia, without regard to conflict of laws principles. You agree that any dispute arising out of or related to these Terms or the Site will be brought exclusively in the courts located in British Columbia, Canada, and you consent to the personal jurisdiction of those courts.
We may update these Terms from time to time. The updated version will be posted on this page with a revised Effective Date. Your continued use of the Site after changes take effect constitutes your acceptance of the updated Terms. We encourage you to review this page periodically.
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions will remain in full force and effect.
These Terms, together with our Privacy Policy and any written agreements between you and Variant1, constitute the entire agreement between you and Variant1 with respect to your use of the Site and supersede all prior or contemporaneous communications and proposals on that subject.
